1. Agreement to Terms
By requesting a quote, placing an order, or using the website gleasonsails.com, you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and Gleason Marine Inc., a South Carolina S Corporation doing business as Gleason Sails ("we," "us," "our").
If you do not agree to these terms, please do not use our services or website.
2. Our Services
Gleason Sails designs and manufactures custom sails for sailboats, including but not limited to:
- Full-batten mainsails
- Dacron mainsails
- Genoas and headsails
- Asymmetrical spinnakers
- Storm sails and trysails
All sails are custom-made to order based on specifications you provide. Gary Gleason personally designs and oversees the construction of each sail.
3. Custom Orders
Specifications
You are responsible for providing accurate specifications for your sail, including but not limited to: boat make, model, year, rig measurements, sail dimensions (luff, leech, foot), and intended use. Gleason Sails will confirm specifications with you before beginning production.
Order Confirmation
An order is confirmed only when Gary Gleason acknowledges your specifications in writing (email or letter) and you have made any required deposit payment. We reserve the right to decline any order.
Changes After Confirmation
Material changes to specifications after order confirmation may result in additional charges or production delays and must be agreed upon in writing by both parties.
Non-Refundable Custom Work
Because all sails are custom-manufactured to your specific measurements, completed sails are non-refundable unless the sail materially fails to conform to the confirmed specifications. If a sail does not conform to the agreed specifications, Gary Gleason will work with you to correct the issue, which may include alterations or, at his sole discretion, replacement.
Production Time
Estimated production times will be communicated at the time of order confirmation. Gleason Sails will make reasonable efforts to meet estimated timelines but is not liable for delays caused by material availability, shipping, weather, or other circumstances beyond our control.
4. Pricing & Payment
Pricing is quoted individually for each custom order based on sail type, size, materials, and complexity. All prices are in US dollars.
Payment terms will be communicated at the time of quote. Gleason Sails may require a deposit before beginning production. Final payment is due prior to or at time of delivery, unless otherwise agreed in writing.
Quoted prices are valid for 30 days from the date of the quote. We reserve the right to adjust pricing if material costs change before order confirmation.
5. Warranty
3-Year Workmanship Warranty
Gleason Sails warrants that all custom sails are free from defects in workmanship for a period of three (3) years from the date of delivery to the original purchaser. This warranty is non-transferable.
What Is Covered
- Seam failures or separation under normal sailing conditions
- Hardware failures (grommets, slides, slugs) due to defective installation
- Premature cloth delamination or failure not caused by abuse or negligence
What Is Not Covered
- Damage from improper storage, UV exposure beyond normal use, or failure to maintain the sail
- Damage caused by abnormal conditions (storm damage, accidental tearing, chafe)
- Normal wear and tear, fading, or softening of sailcloth
- Modifications made by anyone other than Gleason Sails
Warranty Claims
To make a warranty claim, contact Gary Gleason at 843-301-2097 or gleasonsails@gmail.com with a description of the defect and photos. We will evaluate the claim and, if warranted, repair or replace the sail at our discretion.
6. Limitation of Liability
To the fullest extent permitted by applicable law, Gleason Marine Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of use of the vessel, damage to the vessel, personal injury, loss of racing position, or any other loss arising out of or related to the use of our products, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from a custom sail order shall not exceed the amount paid by you for that specific sail.
Some states do not allow limitation of consequential damages; if you are in such a state, the above limitation may not apply to you.
7. Intellectual Property
All designs, patterns, and technical drawings created by Gary Gleason in connection with your order remain the intellectual property of Gleason Marine Inc., unless otherwise agreed in writing. You are granted a limited, non-transferable license to use the sail for its intended purpose.
All content on gleasonsails.com, including photographs, text, and graphics, is owned by or licensed to Gleason Marine Inc. and may not be reproduced without written permission.
8. Disputes & Governing Law
These Terms of Service are governed by the laws of the State of South Carolina, without regard to conflict of law provisions.
Any dispute arising out of these terms or your purchase shall first be addressed through good-faith negotiation. If the parties are unable to resolve the dispute informally within 30 days, the dispute shall be submitted to binding arbitration in Oconee County, South Carolina, under the rules of the American Arbitration Association.
You waive any right to participate in a class action lawsuit or class-wide arbitration against Gleason Marine Inc.
9. Changes to These Terms
We may update these Terms of Service from time to time. We will post the revised terms on this page with an updated effective date. Your continued use of our website or services after changes are posted constitutes acceptance of the revised terms.
